TERMS AND CONDITIONS & HIRE AGREEMENT

Thank you for taking care of our hire equipment as if it were your own and returning our items in the same condition as you received them-clean and stacked and in their original packaging

1. Agreement

These Terms & Conditions form a binding agreement between Martyville Bash & Barrel Hire (“Owner”) and the customer (“Hirer”). By paying a deposit or full payment, the Hirer accepts these terms.

2. Definitions

  • Owner: Martyville Bash & Barrel Hire.

  • Hirer: The individual, firm, or corporation hiring equipment.

  • Equipment: All items hired by the Owner.

  • Event Date: The date of the Hirer’s event.

3. The Hirer

The Hirer will hire the Equipment at their own risk and accept full responsibility for the Equipment hired from delivery/pick up until  return/collection to Owner. 

The Hirer must:

  • Use the Equipment in a proper, safely and only as intended.

  • ​​Follow any written instructions provided.

  • ​​Not sub-hire, alter, or relocate Equipment without Owner’s consent.

  • Protect all items from rain and weather damage.

  • Indemnify the Owner against all claims, injuries, damages, or losses arising from use.

4.Hire & Delivery Information

Hire Periods

Our standard hire rate covers Thursday & Friday pick-up to Monday return.

Early Collection or Extended Hire
Because our hire items are in high demand and each piece is prepared for upcoming bookings, early collection or extended hire is available.

 

Extended Hire Fee: Need your items earlier for setup or styling, or want to keep them longer? You can add extra days to your hire period for 25% of the total hire cost per additional day (subject to availability).  Extended hire is available for early self pick up and delivery (Wednesday) or late returns and collections (Tuesday) subject to availability.

Self Pick-Up & Return
Prefer to save on delivery and collect your hire items yourself? Our self pick-up option is available Thursday & Friday afternoons with easy drive-up access. Return Monday — or Sunday by arrangement. ​

Please note: All item prices listed on our website apply to standard self pick-up hire only.
If you require delivery, please use the Delivery Quote Form to request a personalised delivery and collection price.

Full Service Hire — Delivered & Collected

Delivery and collection are available for large bookings or where self-pick-up isn’t possible.


Prefer a stress-free setup? We’ll deliver your hire items on Thursday or Friday afternoon (around 4.30–5.00pm) so everything’s ready for your weekend event.

Collection takes place on Monday afternoon — giving you time to relax and enjoy your celebration without any Sunday interruptions.

Delivery and collection are charged separately and are based on your event location, access, and order size (whether we use our van or truck).

Because this service is limited and requires two people for handling, we reserve it for pre-approved bookings and charge accordingly.

5.Booking & Payments
To secure your booking, a non-refundable deposit is required. The amount varies depending on how far out your event is — you’ll find all the details in our Payments & Cancellations Schedule below.

Our items book out quickly, especially during weekends and wedding season.

6.Equipment Ownership & Use

  • All equipment supplied for hire remains the property of Martyville Bash & Barrel Hire at all times. The Hirer acknowledges that no ownership rights or options to purchase are conferred through this hire agreement.

  • The hire period begins at the date and time of pick-up or delivery as specified by the Owner, and items must be returned or collected by the agreed return date.

  • Care of Equipment: Our hire items are not designed to get wet and must be protected from rain, damp, and moisture at all times, including during transport and storage. The Hirer will be invoiced for any water damage.

  • The Hirer accepts full responsibility for the care, safekeeping, and return of all hired items during the hire period, including responsibility for any loss or damage.

  • The Hirer is also responsible for ensuring that guests and attendees use the hired equipment safely and appropriately.

Barrel Hire

Barrels are heavy and weigh approximately 50 kgs. Our barrel hire rate does not include set up at your event location and we are happy to leave a trolley for you to move the barrels around and set them up in the layout that you prefer.  Barrels are NOT to be rolled on their bellies, you will be charged for damages.

Arbour Hire

Our arbours are large and must be picked up or delivered unassembled.  Assembly and setup are required at your event location.  Please note that the hire rate for arbours does not include assembly or set up however we are happy to leave the required tools with you for self assembly.  If you require assistance, we offer an arbour assembly and setup service-please enquire for more details. 

Games Hire

It is the responsibility of the Hirer to notify the Owner of any missing game pieces or damage at the commencement of hire.  The Hirer will be invoiced for the loss of game pieces and or damage to game boards.

Cornhole

The Cornhole game set includes two large timber boards, along with 4 red and 4 blue bean bags. Please note that any missing bean bags will incur a replacement fee of $20 per bag, and additional charges apply for any damages to the game boards.

Giant Connect 4

Included with giant connect 4 is 21 red and 21 yellow discs.  Replacement discs will be invoiced at $10 each. 

Americana Gladiator Chairs

To keep our white wedding chairs in the best possible condition for all hirers, eight or more Americana Gladiator chairs must be transported flat and loaded and tied down onto a supplied trolley at no additional charge to prevent damage in transit.

 

Vintage Timber High Chair – Safety & Use Policy

Our vintage timber high chair is a beautiful, rustic piece perfect for styled setups, cake smashes, and baby photoshoots. Please note, this is a decorative vintage item and not a certified modern high chair.

To ensure safe and enjoyable use, the hirer agrees to the following:

  • Supervised Use Only – A responsible adult must be present at all times when a child is in or near the chair.

  • Not for Feeding or Everyday Use – This chair is intended for brief, staged use only such as photographs or display styling.

  • No Unattended Children – Children must never be left unattended in or around the chair.

  • Hirer Responsibility – The hirer accepts full responsibility for the safe and appropriate use of the chair during the hire period.

  • Liability – Martyville Bash & Barrel Hire is not liable for injury, accident, or damage resulting from misuse or unsupervised use.

This way, you can enjoy the timeless look of a vintage piece in your special photos, while keeping little ones safe.

7. Payment for Hire

  • Written quotes are valid for 7 days. After this time, items not confirmed will be released and made available for other bookings.

  • A non-refundable deposit is required to confirm your booking as per the Payments & Cancellations Schedule below. Until the deposit is received, all items remain available for hire.

  • By paying a deposit or the full balance, the Hirer accepts Martyville Bash & Barrel Hire’s Terms & Conditions and Hire Agreement.

  • The Hirer agrees to pay the hire charges in full, along with any additional costs for loss, damage, cleaning, or repairs if they occur.

  • If the balance is not paid by the due date, the booking may be cancelled and items re-hired, with the deposit retained.

  • Accepted payment methods: bank transfer and cash.

Please note that all bookings remain firm regardless of weather conditions, including rain, wind, or cyclones. As our items are reserved exclusively for your event date, we are unable to provide refunds, credits, or cancellations due to weather. We recommend arranging a suitable undercover or indoor backup plan to ensure your event can proceed regardless of conditions.

Changes to Bookings

Reducing Items

  • Once your booking is confirmed, hire items are reserved exclusively for your event date.

  • If you reduce items more than 14 days before your event, your final balance will be adjusted to reflect the reduced hire amount.

  • Please note: any payments already made (deposits or instalments) are non-refundable and will not be refunded, even if fewer items are required.

  • Adding Items: Additional items may be requested after your booking has been confirmed. These will be subject to availability and invoiced separately.

Cancellation By the Owner
If Martyville Bash & Barrel Hire must cancel due to unforeseen circumstances beyond our control (such as sudden illness, vehicle breakdown, or inability to provide delivery and collection where agreed), a full refund of all amounts paid will be issued.

9. Delivery & Collection Service, Self Pick Up & Return

  • Delivery fees vary depending on distance, access, and item size/weight.

  • Hirer must provide clear, safe access for delivery and collection. Items will not be carried upstairs, over obstacles, or across difficult terrain unless agreed in advance.

  • For self pick-up, Hirer must have a suitable vehicle, blankets, and tie-downs. Items damaged in transit are the Hirer’s responsibility.

  • Unless a setup fee has been noted and charged to the Hirer on the Invoice and agreed upon by the Owner, the Owner is not responsible for the setup of equipment.

  • Late returns will incur additional hire charges.

10. Loss, Damage & Cleaning

  • Hirer is liable for all damage, loss, theft, or vandalism (beyond fair wear and tear).

  • Charges apply for repairs, replacement, cleaning, or late returns.

  • Barrels returned with belly-roll damage will be charged.

  • Equipment returned dirty will incur a cleaning fee.

11. Release and Indemnity

The Hirer hereby releases the Owner from, and agrees to indemnify the Owner in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or the Hirer’s breach of any of these terms.
